Important Notice — Not a Financial Service or Product

Micromarkets is a data analytics and information service. We do not provide financial services or financial products, personal financial advice, legal advice or consumer-credit services. We do not hold an Australian Financial Services Licence (AFSL) and we do not issue, deal in, arrange or recommend interests in any managed investment scheme, security or other financial product under the Corporations Act 2001 (Cth).

All content is general information only and does not take into account your objectives, financial situation or needs. Do not rely on it as the sole basis for any investment, lending, valuation, development or purchasing decision. Seek independent, licensed professional advice.

Micromarkets does not offer, solicit or facilitate loans or credit, assess consumer creditworthiness, or provide tenancy screening decisions. Past performance is not a reliable indicator of future performance. Any hypothetical or back-tested results have inherent limitations.

Introduction & Acceptance of Terms

Welcome to Micromarkets, operated by MICROMARKETS TECHNOLOGY PROPRIETARY LIMITED ("Micromarkets," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of micromarkets.ai and all related web apps, dashboards, APIs, data and software (collectively, the "Service").

By accessing or using the Service you agree to be bound by these Terms in full. If you do not agree, you must not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

Service Description

Micromarkets delivers data-analytics and market intelligence for Australian real-estate micro-markets.

The Service is provided for your own internal research and analysis — whether you use it for business purposes or for your own personal property or investment research. It must not be used to provide financial product advice to any other person, to operate or promote a managed investment scheme, to make lending, credit or tenancy-screening decisions, or for any activity requiring regulatory authorisation (including an AFSL or an Australian Credit Licence).

Unless otherwise set out in a separate written agreement, the Service is provided solely for your own internal business, investment or personal research.

"Real-time" Data Explained

"Real-time" (or "near real-time") in these Terms means datasets refreshed on a monthly cycle and presented as a rolling three-month window after quality-control checks. The Service does not provide instantaneous day-by-day feeds.

Update cadence may vary by dataset and supplier. Where a metric uses a rolling window, the data may lag the current date by up to 45 days following quality control or provider release schedules.

Account Registration

  • Provide true, current and complete registration details.
  • Keep your login credentials confidential.
  • Notify us immediately of any unauthorised use of your account.

You represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.

You may register or sign in using a third-party identity provider (currently Google, LinkedIn, X or GitHub). If you do, you authorise us to receive the limited account information they share with you at sign-in (see our Privacy Policy), and your use of that login remains subject to the provider's own terms. We are not affiliated with, endorsed by or sponsored by these providers, and their names and logos are the trademarks of their respective owners. You remain responsible for the security of any third-party account you use to access the Service.

Subscriptions, Reports, Fees & GST

Plans

We offer subscription plans — currently Access, Professional Plus and Executive Plus — billed monthly or annually (annual plans are offered at a discount to the equivalent monthly price). Current plans, features and prices are shown in-product and on our pricing page before you purchase, and may change from time to time.

Prices, GST & tax invoices

All prices are in Australian dollars (AUD) and are inclusive of GST. We issue a tax invoice showing our ABN (67 683 366 378) for each charge. Payments are processed by Stripe; we do not store your full card details.

Auto-renewal

Subscriptions are continuous and automatically renew at the end of each billing period (monthly or annual) at the then-current price, until you cancel. By subscribing you authorise us and our payment processor to charge your nominated payment method for each renewal, without further action by you, until your subscription is cancelled (see "Cancellation & Refunds"). To avoid the next charge, cancel before your renewal date.

One-off suburb reports

Separately from subscriptions, you may purchase individual suburb reports. Your first report is free; additional single reports are priced as shown at checkout (currently $49 for non-subscribers and $24.99 for active subscribers purchasing beyond their plan's allowance), in AUD inclusive of GST. Access to a purchased report is for your own use and may be time-limited; one-off reports do not auto-renew.

Price changes

We may change prices from time to time. We will give you reasonable notice (by email or in-product) before a change takes effect, and any change applies only from your next renewal. If you don't accept a new price, you may cancel before it takes effect.

Failed payments

If a payment fails or your account becomes past due, we may retry the charge and may suspend or restrict access to paid features until the outstanding amount is paid.

Cancellation & Refunds

Subscriptions are month-to-month (or year-to-year for annual plans) with no lock-in. You may cancel at any time from your dashboard settings or by emailing contact@micromarkets.ai. Cancellation takes effect at the end of your current paid period; your access continues until then and the subscription does not renew after that.

Refunds (subject to the ACL). Because the Service is a digital product delivered immediately and on an ongoing basis, we generally do not provide refunds for change of mind, or pro-rata refunds for the unused portion of a paid period (you keep full access until the period ends). One-off reports are delivered on purchase and are likewise generally non-refundable for change of mind. None of this limits your rights under the Australian Consumer Law (see "Consumer Guarantees"). If a report fails to generate, cannot be accessed, or is materially not as described, or there is any other failure to meet a consumer guarantee, you are entitled to a remedy.

If you believe you have been charged in error (for example a duplicate charge or a charge after a valid cancellation), contact us within a reasonable time and we will investigate and refund genuine billing errors. Where possible, please contact us before raising a chargeback so we can resolve it directly.

Licence & Intellectual-Property

Subject to payment of fees and compliance with these Terms, Micromarkets grants you a non-exclusive, non-transferable, revocable licence to use the Service for your internal purposes.

  • All IP in the Service remains with Micromarkets or its licensors.
  • You must not copy, resell, scrape, reverse-engineer or otherwise exploit the Service except under an authorised API or output licence.

Exports, API Access & Rate Limits

Exports and API access (where offered) are subject to per-account rate limits, query caps and fair-use thresholds set by Micromarkets. We may throttle, suspend or revoke access if limits are exceeded or misuse is detected.

You must retain all attribution, copyright notices and required identifiers in any permitted export.

Third-Party, Government & Partner Data

Scope of Licensed Data

Micromarkets incorporates information ("Licensed Data") obtained under licence or statutory authorisation from:

  • Government & Statutory Bodies — the Australian Bureau of Statistics, every State / Territory Land Registry, Valuer-General office, the Reserve Bank of Australia, prudential regulators, local councils and planning authorities.
  • Market-Activity & Partner Feeds — direct listing feeds, verified off-market sales and rental transactions, and other datasets supplied under confidential agreements with real-estate networks and industry bodies.
  • Economic & Expert Analysis — research and forecasts produced by property economists, financial institutions and specialist consultancies.

Examples are illustrative only; supplier relationships may change without notice.

Ownership, Provider Terms & Copyright

All copyright, database rights and other intellectual-property rights in the Licensed Data remain vested in the relevant provider.

State / Territory Property Data — Universal Copyright & Disclaimer.
© State or Territory Government 2025 (or the year indicated within the dataset). By permitting use of this information, each State or Territory Government:

  • retains full copyright and all related rights in its property-sales, valuation and cadastral data;
  • supplies the data without any warranty (including accuracy, reliability, completeness, currency or suitability);
  • disclaims all liability (including negligence) for any loss, damage or expense arising from use of the data; and
  • prohibits use of the data for direct marketing in breach of privacy legislation.

Permitted Use

Your access to Licensed Data is limited to viewing and analysing it through the Service for your internal business or investment purposes. Except where we offer an export or API facility, you must not:

  • reproduce, republish or on-sell Licensed Data;
  • remove proprietary notices, cadastral identifiers or required attribution statements;
  • combine or match Licensed Data with other datasets to create a competing product or service; or
  • use Licensed Data in a way that breaches privacy, spam or consumer-credit legislation.

Provider Disclaimers & "As-Is" Supply

Licensed Data is supplied "as is." Each data provider expressly disclaims all warranties—statutory, express or implied—and limits its liability to the fullest extent permitted by law. Micromarkets passes those disclaimers through to you in full.

Indemnity for Misuse

You agree to indemnify and hold harmless Micromarkets and every Licensed Data provider against any claim, loss or cost (including legal fees) arising from your breach of this clause or of a provider's mandatory conditions.

Timeliness, Attribution & Audit

Licensed Data is generally current only as at its stated publication date. You must retain all required attribution and identifiers in any permitted export. On reasonable notice, you will provide records demonstrating compliance with applicable provider terms. Provider-specific flow-down conditions we notify to you are incorporated by reference.

By continuing to use the Service you acknowledge these restrictions, disclaimers and obligations, and you agree to comply with all provider-specific terms that accompany the Licensed Data.

Acceptable Use

  • No unlawful, defamatory, misleading or discriminatory activity.
  • No malware, denial-of-service, or interference with Service security.
  • No spam or unauthorised marketing communications.
  • No impersonation of Micromarkets or any other person.
  • No circumvention of technical usage limits.
  • No use to provide investment or financial advice, third-party portfolio recommendations, fundraising or marketing for a managed investment scheme.
  • No use to determine consumer creditworthiness, loan eligibility or tenancy-screening outcomes.
  • No automated scraping or bulk exporting beyond published limits, and no creation of substitute/competing datasets.

We may monitor compliance and suspend access for violations.

Disclaimers

No advice — information is general only and not financial, legal or real-estate advice. Seek independent professional advice.

Service "as is" — we do not warrant uninterrupted or error-free operation, or that the Service is virus-free.

Accuracy — while reasonable efforts are made, we do not guarantee completeness, currency or accuracy of data.

Model Outputs — indices, forecasts, scores and back-tested or simulated analytics are illustrative only and may differ from realised outcomes.

Past Performance — not a reliable indicator of future performance.

Consumer Guarantees (ACL)

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) — including that services are provided with due care and skill and are reasonably fit for any purpose you have told us about. Nothing in these Terms excludes, restricts or modifies those guarantees.

If we fail to meet a consumer guarantee, the remedy depends on the failure. For a major failure you may cancel and choose a refund, or seek compensation for any drop in value; where a digital product is involved you may instead choose a refund or replacement. For a minor failure, we will fix the problem within a reasonable time, and if we cannot or do not, you may cancel for a refund of the affected service or have it remedied and recover the reasonable cost. You may also be entitled to compensation for reasonably foreseeable loss. To make a claim, email contact@micromarkets.ai.

Availability & Support (No SLA)

Unless a separate Service Level Agreement applies, the Service has no guaranteed uptime. Maintenance windows may be scheduled with notice where practicable.

Trials & Beta Features

Trials and beta features are provided as-is, may be enabled or withdrawn at any time, and may collect usage data to improve the Service. Features, outputs and performance may differ from generally available releases.

Feedback

If you provide comments, ideas or suggestions about the Service ("Feedback"), you grant Micromarkets a perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce and exploit the Feedback without restriction.

Limitation of Liability

Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL or any other law that cannot lawfully be excluded. Where the Service comes with a consumer guarantee that cannot be excluded but our liability for failing to comply with it can lawfully be limited, our liability is limited (at our option) to re-supplying the services or paying the cost of re-supply or, for any goods or digital products, to replacing or repairing them or paying the cost of doing so.

Subject to the paragraph above and to the maximum extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the fees you paid in the preceding six (6) months, and we are not liable for indirect, special or consequential loss, or loss of profit, revenue, data or goodwill.

Nothing in these Terms limits liability for wilful misconduct, fraud, or death or personal injury caused by our negligence.

Indemnity

You will indemnify and hold harmless Micromarkets, its officers, employees, agents and data providers from any claims, losses or costs arising out of (i) your breach of these Terms, (ii) your misuse of the Service, or (iii) your violation of law or third-party rights.

Confidentiality & Data Security

We implement reasonable administrative, technical and physical safeguards to protect your confidential information. You must keep any non-public aspects of the Service confidential and notify us promptly of suspected security breaches.

We process personal information in accordance with our Privacy Policy. You are responsible for having a lawful basis to upload any personal data and must not upload sensitive information unless the product explicitly supports it. You retain ownership of your uploads; you grant Micromarkets a licence to host, process and display them to deliver the Service.

Suspension & Termination

We may suspend, restrict or terminate your access if you materially breach these Terms and (where the breach can be remedied) do not remedy it within a reasonable time after we ask you to, if your payment fails or is past due, if we reasonably believe your use poses a security, legal or operational risk, or if we are required to by law. Where it is reasonable and lawful to do so, we will give you notice first. On termination, your licence ceases and you must delete Service data in your possession, except where retained for compliance. This does not affect your rights under the ACL.

Following termination we will disable access immediately. Customer content will be deleted or de-identified within 90 days unless retention is required by law or by provider terms; system logs and backups may persist for security and audit.

Modifications to Service & Terms

We may add, modify or remove features at any time. Material changes to these Terms will be announced at least 14 days in advance by email or in-product banner (sooner if required for legal or security reasons). Continued use after the effective date constitutes acceptance.

Dispute Resolution

Before commencing court proceedings, the parties will attempt to resolve disputes through good-faith negotiations, then mediation in Victoria, Australia. This does not prevent a party seeking urgent injunctive relief.

Sanctions, Export Control & Anti-Bribery

You must comply with applicable sanctions, export-control, anti-bribery and anti-corruption laws. You warrant you are not a sanctioned person and are not located in a sanctioned jurisdiction.

Publicity

With your consent, we may use your name and logo in customer lists and case studies. You may withdraw consent at any time by written notice.

Assignment

We may assign or novate our rights and obligations under these Terms (for example, as part of a sale or reorganisation of our business) on reasonable notice to you, provided your rights under these Terms are not materially reduced. You may assign your rights only with our prior written consent.

Severability

If any provision is held invalid, the remainder of the Terms will continue in effect. The invalid provision will be replaced by one that most closely reflects the original intent.

Governing Law & Jurisdiction

These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria.

Entire Agreement

These Terms, together with our Privacy Policy, any Order Form, SLA or API agreement, constitute the entire agreement between you and Micromarkets and supersede all prior understandings.
